In addition, the U.S. Occupational Safety and Health Administration (OSHA) has stated in several of their letters of interpretation that exceeding a recommended OEL would not be the basis of their enforcement action, but a general duty clause citation would have to be issued on the basis of failing to mitigate a recognized hazard.
